Our Deed of Gift contains a clause that transfers, etc all ownership rights, including copyright, title interest and possession to our foundation. About two years ago an issue came up concerning copyright of a book and a photo-book being donated by the author. As a result we added a phrase that states "The person making the gift may only transfer those rights that they have legal ownership of."

There is a plethora of info out there for museums to determine if they can use images and photos for exhibits etc. What I am trying to determine is rights when requested for use by another person or organization, such as a newspaper or filmmaker. We do not hold copyright to all the images in our collection. If we at least have a deed of gift for them, can we give out requested copies? Any resource to help determine this would be super helpful. Most of our collection has been scanned and so researchers and visitors can look at the images in our collection and often want to purchase copies for separate projects.
